Proprietary is what Ethernet/IP was before giving it over to ODVA.

Ethernet/IP does not require special hardware.
The Ethernet/IP protocol specifications have always been available but at certain time the documents costs money.

Delta Computer Systems was the second company to implement Ethernet/IP. We paid $500 at that time to get a pre-release spec.

The confusion is how the term Industrial Ethernet is used. Siemens used it to describe their early Ethernet protocol before ProfiNet. There are a lot of protocols that would qualify as being used in Industrial Ethernet applications.
